Trademarks and Other Distinctive Signs

Trademarks

Trademarks are any sign capable of distinguishing a product or a service from other of the same type or class.

The following signs can be considered a Trademark:

Words and common names

Any Word, including proper and common names, as long as those words or names are not descriptive of or generic for the products or services to be identified with the same (relief for medication, fashion for clothing, education for schools, etc.) or that cannot be used exclusively by any person by legal disposition.

Graphic designs

Graphic designs (Logotypes, drawings, or any kind of image of a person, characters, animals or any object).

3-D shapes

3-D shapes (Packaging, bottles and any shape or presentation of products.).

Mixed marks

Are the combination of two or more of the aforementioned signs.

The right to the exclusive use of a trademark is acquired through registration.

Slogans

Slogans are commercial phrases which are intended to advertise products, services or establishments to the consumers.

The right to the exclusive use of a slogan is acquired through registration.

Commercial names

This legal figure is identified by the Industrial Property Law as the name of a company, a commercial, industrial or services establishment.

Commercial names are protected without the need of registration.
